First reason: alertness

That alone is enough to settle the question, before we even get to roadside checks: a product that affects alertness is incompatible with driving. Car, motorbike, e-scooter, but also machinery and tools: the rule is the same.

Second reason: the saliva test

At a roadside check, the police use a saliva screening test, which is then confirmed by a lab analysis. Two points matter for you.

It looks for THC. Not CBD, not a range name: the presence of THC.

It has no tolerance threshold. Whereas alcohol is measured in grams per litre, the offence of driving after using controlled substances is established by the mere presence of the substance.

Yet a compliant product isn't a THC-free product: French law allows up to 0.3%. Those traces can be enough to make a test come back positive. Nobody can guarantee you a negative result — not us, not any seller.

What the driver risks

In France, driving after using substances classified as controlled substances is an offence under article L235-1 of the Code de la route, the French Highway Code. It carries a penalty of 2 years' imprisonment and a €4,500 fine, means 6 points are taken off your licence, and can come with additional penalties such as suspension or cancellation of your licence.

The law penalises detected THC regardless of where it came from. Having bought a legal product, receipt in hand, changes nothing about the result of the test.

How long should you wait?

There's no reliable waiting time we can give you. How long traces remain detectable depends on the person, the quantity, how often they use it and the test used. Be wary of any promise along the lines of "after so many hours, you're fine".

The only safe rule: on a day you use it, you don't get behind the wheel. Plan ahead: a driver who hasn't used anything, public transport, a taxi.
